    Hi, I’m trying to get started with Gunsmithing and I was just curious about the process for an NFA item like a suppressor. Once you file your form 1 the can has to remain in the custody of an FFL until the stamp arrives. I was just wondering if I am the FFL, can I have the device in my own custody? Or if I’m misunderstanding the process, please let me know.

    Form 1 is for making your own item, and you can’t build it until the form is approved.

    Form 4 is for transfers. If you’re the SOT, then yes you can possess it – as can employees of the SOT. As long as you have the SOT, the only advantage I know of for actually doing the F4 to get it in your name is that it’s then off the books of your SOT.

    It would be on a Form 4 if you wanted to take personal ownership of the silencer, as an appropriately licensed and taxed FFL/SOT you could use your silencer while the approval is in process. Your business could own a silencer as a demo on a Form 3, you would not ever personally own the silencer in this case.

    I’d wager it would have to stay at the address your FFL is registered to until stamp clears but im no expert.
