I’m 22 with no concealed carry. For Christmas my dad gifted me a sd40 because my background check never came back to buy it in my name. Can I get in trouble for carrying it if it’s in his name. State of Ky you don’t need a license to conceal just thought I’d ask. Thanks (I’m not a felon or anything)

GuestMay 17, 2021 at 11:44 pmthe gun is not registered.
the record will show that it was sold to your father. what your father does with his property is his business.
there are some limitations placed on people under age of 21. but you say you are older.
there are some limitations placed on people who are felons. but you did not say that you are one of them

unless the state requires each person to register that firearm, once it leaves the ffl then thats all the paperwork that is needed
if you want you can ask your dad for a bill of sale

GuestMay 17, 2021 at 11:44 pmIf he gave it to you as a bona fide gift then it’s perfectly legal if you’re legal to own in the first place and there is no registry here. As long as you didn’t give him money in order to purchase the gun using his name.

GuestMay 17, 2021 at 11:44 pmThere’s no registry. It’s not in his name, he just bought it. Then he gave it to you. It is now yours.

GuestMay 17, 2021 at 11:44 pmIt’s not in anyone’s name as far as I know. This is how people are able to (legally) sell firearms to other people within their states via private sales or trades within their own state. As long as you and your dad live in the same state you should be fine. The only reason it would be an issue if there is any condition that would make you unable to legally own a firearm (such as being a felon). You don’t need a conceal carry permit to carry a pistol open carry, it’s only illegal if you intentionally conceal it.
That being said the onus is up to you to read up on your local and federal laws and not take a redditors at their word.

GuestMay 17, 2021 at 11:44 pmCheck your state gun laws, nothing said here should be taken as legal advice. https://www.nraila.org/gun-laws/state-gun-laws/kentucky/ This might be a good place to start
